Customer Agreements and Installation Terms

Overview
By purchasing products or installation services from Fusion Elec Ltd (“Fusion Electrics”, “we”, “us”, “our”), you agree to be bound by the terms set out in this section, together with our full Terms and Conditions of Sale and our Privacy Policy. -
Customer Agreement
When you place an order with us (either via our website, by telephone, or through a representative), we will issue a written Customer Agreement setting out the key details of your purchase, including:-
Your contact and installation details;

Product description and quotation;

Installation price and payment terms;

Applicable assumptions, limitations, or exclusions; and
-
Maintenance and warranty terms.
The Customer Agreement must be signed and returned to us before any products are supplied or installation work is scheduled. Once signed, it forms a legally binding contract between you and Fusion Electrics Ltd.

Payment Terms
Full payment is required in advance of installation unless otherwise agreed in writing. Payments can be made by debit/credit card, secure payment link, or bank transfer.

Installation and Maintenance

Installations will be carried out by an approved Fusion Electrics installer at the address stated in your Customer Agreement.

Standard installations are subject to the assumptions detailed in your quotation; additional costs may apply if unforeseen work is required.

Maintenance services (where applicable) will be delivered as described in your Maintenance Terms and Conditions.

Right to Cancel (Consumers)
If you are a consumer purchasing for personal use, you have a legal right to cancel your order within 14 days of signing your Customer Agreement (“Cooling-Off Period”).-
If installation begins during this period at your request, you may be charged for any work completed and for restoring the property if necessary.

Once installation is complete, your cancellation right no longer applies.

Warranty and Liability
All products and installations include the manufacturer’s warranty plus our standard workmanship warranty as set out in your Customer Agreement.
Fusion Electrics is not liable for issues arising from misuse, tampering, or unauthorised modifications. -

Fusion Gas Ltd – Terms and Conditions of Sale

These Terms and Conditions (“Terms”) govern the sale, installation, and servicing of products and related works (“Works”) carried out by Fusion Gas Ltd or Fusion Elec Ltd (together referred to as “Fusion”, “we”, “us”, or “our”) for you, the customer (“you”, “your”). 1. Interpretation
Definitions:
Engineer – A person approved by Fusion Gas Ltd to carry out the Works.
Works – The services or installations as specified in your quote or order confirmation.
Payment – The total sum payable for the Works.
Property – The address where the Works will be performed.
Due Date – The date of completion of the Works.
Annual Service Visit – The annual gas boiler service as outlined in Section 16.
Service Fee – The total amount payable for an Annual Service Visit (including VAT).
Event Outside Our Control – Any event beyond our reasonable control including, but not limited to, strikes, severe weather, fire, flood, pandemic, or supply chain disruption.
Words in the singular include the plural and vice versa. Headings are for convenience only and do not affect interpretation.

3. Agreement Formation
We will provide you with a written Fixed Price Quote outlining the Works.
A contract is formed only once we issue an Order Confirmation, following your acceptance of the Fixed Price Quote (via email, phone, or written signature).
Quotes are valid for 30 days unless otherwise stated.
A deposit may be required before any Works are scheduled.
If a site survey reveals that additional work, safety concerns, or material variations are necessary, a revised quote will be issued for your approval.
All materials remain our property until full payment has been received.

5. Quality Assurance
We commit to performing all Works in accordance with Good Industry Practice and using qualified engineers, appropriate materials, and recognised safety standards.
6. Agreement for Works
Works will be performed as described in your Scope of Works and quote.
Any additional work requested after commencement may incur extra charges.
You must ensure safe and clear access to the work area.
We will not handle asbestos; any asbestos discovered must be removed by a licensed contractor before work continues.
Any redecorating, tiling, or cosmetic finishing following installation is your responsibility.
Minor cosmetic or access damage during installation may occur and is not included in our quoted price for repair.
You warrant that you are the property owner or have the landlord’s written consent to carry out the Works.
We reserve the right to take photographs of completed Works for quality assurance, audit, or training purposes.
7. Price and Payment
Prices are as stated in the accepted Fixed Price Quote.
Payment methods accepted: Visa, Mastercard, Maestro, Bank Transfer, or Cash.
Full payment is due on completion of the Works unless agreed otherwise.
Late payments may incur interest and administrative fees.
Materials remain Fusion’s property until paid for in full.
8. Issues and Defects
If you experience any issue with the Works, notify us immediately by phone or email and allow us reasonable time to inspect and correct any defect.
We will repair or replace defective work if caused by our negligence.
Call-outs unrelated to workmanship faults may incur a service charge.
9. Consumer Cancellation Rights
You have 14 days from accepting the quote to cancel under the Consumer Contracts Regulations 2013, unless the Works have already begun at your request.
If cancellation occurs after work has started, you will be charged for completed services and materials.
Cancellations received after 10am the day before a scheduled appointment may forfeit any deposit paid.
10. Termination
We may terminate the agreement if you fail to make payment within 5 business days of the due date, if we are prevented from completing the Works due to your actions, or if you breach any material term of this agreement.
If terminated, we reserve the right to retain payments for work already completed.
11. Manufacturer Warranties
All boilers and parts supplied by Fusion Gas Ltd are covered by the manufacturer’s warranty (typically 7–10 years for boilers, 1 year for parts and labour).
Annual servicing must be completed by a Gas Safe registered engineer to maintain warranty validity.
Warranties are void if systems are tampered with, misused, or serviced by unqualified third parties.
12. Fusion Gas Ltd Warranty
In addition to manufacturer warranties, Fusion Gas Ltd provides a 12-month workmanship warranty covering defects caused by poor installation.
This excludes pre-existing system faults, blockages, or misuse following installation.
13. Opening Hours
Office: Monday – Friday, 8:30am – 4:30pm
Closed: Saturdays, Sundays & Public Holidays
14. Liability – Business Customers
For business clients, Fusion Gas Ltd’s total liability shall not exceed the total contract price.
We are not liable for any indirect, consequential, or loss of profit claims.
15. Liability – Consumers
We are responsible for foreseeable loss or damage caused by our negligence.
We are not liable for pre-existing faults or for business losses arising from domestic installations.
16. Annual Gas Boiler Servicing
Conducted per Gas Safety (Installation & Use) Regulations and manufacturer guidance.
Includes inspection, cleaning, safety testing, and certification.
Excludes repairs, parts, or additional maintenance.
Service must be paid for at booking; cancellations made after 12 noon the prior business day may incur a 50% cancellation fee.
17. Event Liability Period
No legal action may be brought against Fusion Gas Ltd more than six years after completion of the Works.
18. Events Outside Our Control
Fusion Gas Ltd is not responsible for delays or failure to perform caused by events beyond our control, including severe weather, strikes, or supply chain disruption.
19. Other Important Terms
We may transfer or assign our rights under this agreement.
You may not transfer your rights without our written consent.
This contract is between you and us only.
Each clause operates independently; if one is invalid, the rest remain in effect.
This agreement is governed by English law.
Jurisdiction:
Consumers – English and Welsh courts (or Scottish if resident in Scotland).
Businesses – Exclusive jurisdiction of the courts of England and Wales.
